An Act relative to the energy facilities siting board.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1: Section 69H of Chapter 164 of the Massachusetts General Laws, as appearing in the 2014 Official Edition, is hereby amended by inserting after the word “environment”, in line 6, the following words:- and public health.

SECTION 2: Said section 69H of said chapter 164, as so appearing, is hereby further amended by inserting after the word “environmental”, in line 7, the following words:- and public health.

SECTION 3: Said section 69H of said chapter 164, as so appearing, is hereby further amended by inserting after the word “resources”, in line 20, the following words:- the commissioner of the department of public health.

SECTION 4: Said section 69H of said chapter 164, as so appearing, is hereby further amended by striking out, in line 21, the figure “3”, and inserting in place thereof the following figure:- 4

SECTION 5: Said section 69H of said chapter 164, as so appearing, is hereby further amended by inserting after the words “labor issues”, in line 24, the following words:- 1 of whom shall be experienced in public health issues.

SECTION 6: Section 69I of said Chapter 164 of the Massachusetts General Laws, as so appearing, is hereby amended by inserting after the word “impacts”, in line 63, the following words:- public health impacts.

SECTION 7: Said section 69I of said chapter 164, as so appearing, is hereby further amended by inserting after the word “environmental”, in line 82, the following words:- and public health

SECTION 8: Section 69J of said Chapter 164 of the Massachusetts General Laws, as so appearing, is hereby amended by inserting after the word “environmental”, in line 27, the following words:- and public health.

SECTION 9: Said section 69J of said chapter 164, as so appearing, is hereby further amended by striking out, in line 32, the words “and noise impact”, and inserting in place thereof the following words:- noise impact, the delineation of affected populations, and impacts on acute and chronic disease.

SECTION 10: Said section 69J of said chapter 164, as so appearing, is hereby further amended by inserting after the word “environmental”, in line 49, the following words:- and public health.

SECTION 11: Said section 69J of said chapter 164, as so appearing, is hereby further amended by inserting after the words “environment”, in line 68, the following words:- and public health.

SECTION 12: Said section 69J of said chapter 164, as so appearing, is hereby further amended by striking out subsection (3) and inserting in place thereof the following subsection:-

(3) An analysis of the proposed facility including but not limited to the description of alternatives to the planned action, such as other site locations, other oil facilities, and no additional oil facilities, a description of the environmental impact of the proposed facility, said description to include buffer zones and other measures to minimize damage to the environment; and a description of the public health impact, said description to include an assessment on any past, current, or future impact on public health by the release of hazardous substances into the environment. The board shall after public notice and a period for comment be empowered to issue and revise its own list of guidelines. A minimum of data shall be required by these guidelines from the applicant for review concerning land use impact, water resource impact, air quality impact, solid waste impact, radiation impact, noise impact, delineation of affected populations, and impacts on acute and chronic disease.

SECTION 13: Section 69J1/4 of said Chapter 164 of the Massachusetts General Laws, as so appearing, is hereby amended by inserting after the word “environmental”, in line 34, the following words:- and public health.

SECTION 14: Said section 69J1/4 of said chapter 164, as so appearing, is hereby amended by inserting after the word “environmental”, in line 35, the following words:- and public health.

SECTION 15: Said section 69J1/4 of said chapter 164, as so appearing, is hereby amended by inserting after the word “environmental”, in line 41, the following words:- and public health.

SECTION 16: Said section 69J1/4 of said chapter 164, as so appearing, is hereby amended by inserting after the words “radiation impact”, in line 51, the following words:- delineation of affected populations, impact on acute and chronic disease.

SECTION 17: Said section 69J1/4 of said chapter 164, as so appearing, is hereby amended by inserting after the word “environmental”, in line 56, the following words:- and public health.

SECTION 18: Said section 69J1/4 of said chapter 164, as so appearing, is hereby amended by inserting after the word “environmental”, in line 60, the following words:- and public health.

SECTION 23: Section 69L1/2 of said Chapter 164 of the Massachusetts General Laws, as so appearing, is hereby amended by inserting after the word “environmental”, in line 7, the following words:- and public health.
