An Act relative to energy production.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

"SECTION 1.  Subsection b of section 11 F 1/2 of chapter 25 is hereby amended by adding at the end thereof the following:-  "...provided, that biomass woody fuel, manufactured biomass fuel or any forest or farm derived fuel harvested for, shipped to or used by a biomass-fueled power generator under the provisions of this chapter, shall only be sourced sustainably in a manner that utilizes a carbon re-sequestration process that demonstrates a no net loss of forest or crop cover, does not convert harvest areas to non-forest uses, maintains biomass harvest areas in their natural state for a time period that is sufficient to re-sequester the carbon dioxide that was released through the combustion of the biomass, and does not deplete carbon stocks over a reasonable time period and meets sustainability standards promulgated by the department and provided further, that no forest biomass shall be harvested or used by said power generators in violation of the regulatory and statutory provisions contained in the Forest Futures Visioning Process convened by the department of conservation and recreation, and provided further, no biomass woody fuel or manufactured biomass fuel shall be harvested for, shipped to or used by said generators in a manner that violates the greenhouse gas reduction provisions of the Global Warming Solutions Act.".
