An Act relative to autocycle motor vehicle definition and operating requirements.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 1 of Chapter 90 of the general laws, as appearing in the 2014 Official Edition, is hereby amended by inserting the following term therein:-

“Autocycle”, a three-wheel motor vehicle that has a steering wheel and seating that does not require the operator to straddle or sit astride it and that is manufactured to federal motorcycle safety standards.

SECTION 2. Section 1l of Chapter 90 of the general laws, as appearing in the 2014 Official Edition, is hereby amended by inserting the following sentence at the end thereof:-

This section shall not include three-wheel motor vehicles that are defined as an autocycle in Section 1 of Chapter 90.

SECTION 3. . Section 1 of Chapter 90 of the general laws, as so appearing in the 2014 Official Edition, is hereby amended by striking out the definition for “Motorcycle” and inserting in place thereof the following paragraph:-

"Motorcycle'', any motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground, including an autocycle and any bicycle with a motor or driving wheel attached, except a tractor or a motor vehicle designed for the carrying of golf clubs and not more than four persons, an industrial three-wheel truck, or a motorized bicycle.

SECTION 4. Section 8B of Chapter 90 of the general laws, as appearing in the 2014 Official Edition,  is hereby amended by adding at the end thereof the following new text:-

The Registrar will not require a Class M license, permit or endorsement in order to operate an autocycle as defined in Chapter 90 Section 1, but will require all autocycle operators to carry a valid Class D operator’s license.  Operation of an autocycle with a Class D learner’s permit will be prohibited. 

SECTION 5. Section 7 of Chapter 90 of the general laws, as so appearing in the 2014 Official Edition,  is hereby amended by inserting in line, 149, after the word “motorcycle”, the following words:-  or autocycle

Section 7 of Chapter 90 is further amended by inserting in line, 149, after the word “passenger”, the following words:-  in an autocycle or

Section 7 of Chapter 90 is further amended by inserting in line, 153, after the word “motorcycle”, the following words:-  or autocycle

Section 7 of Chapter 90 is further amended by inserting in line, 154, after the word “on such”, the following words:-  autocycle or
