An Act to recognize the rights of a community regarding a petition to construct an energy facility or an oil facility.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
The department of environmental protection under its operating permit and compliance program (310 CMR 7.00: Appendix C) may not issue an operating permit unless the department’s operating permit and compliance program has been provided proof of approval for said operating permit from the host community’s city council or board of selectmen, and of all municipalities abutting the host community.
