An Act protecting schools in an in incineration zone.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
The department of environmental protection under its operating permit and compliance program (310 CMR 7.00: Appendix C) may not issue an operating permit that is within 0.5 miles of a preschool, a K-12 school, youth sports field, or park. For purposes of this act “host community” shall mean the municipality where the applicant seeks to locate the proposed facility.
