Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

Chapter 164 of the General Laws is hereby amended by adding the following section:-

Section 146. Notwithstanding any general or special law, rule, or regulation to the contrary, prior to adding new capacity for natural gas to a system, a gas company shall recapture an equivalent volume of natural gas lost from the system by repairing identified gas leaks within the same municipality.  If all identified leaks in a municipality have been repaired, the gas company shall pursue alternative conservation measures within the municipality or repair identified gas leaks within the region.

The department shall promulgate regulations necessary to implement this section and shall oversee and monitor company repairs.
