An Act relative to the powers of the General Court.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Chapter 3 of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by inserting after section 38C the following section:-

Section 38D. (a) A member of the general court may, notwithstanding any general or special law to the contrary, contact a state agency as defined in section 1 of chapter 30, when inquiring about a constituent without obtaining a release from such constituent.

(b) A member may, notwithstanding any general or special law or rule or regulation to the contrary, refer constituents directly to any state or local agency, organization or non-profit.

SECTION 2. Section 38 of chapter 207 of the General Laws, as so appearing, is hereby amended by inserting after the word “thereunder”, in line 12, the following words:- ; by a member of the general court; provided, however that such member shall not solemnize more than 3 marriages annually; and provided, that no such member shall receive anything of value for such ceremony.

SECTION 3. Chapter 268A of the General Laws is hereby amended by adding the following section:-

Section 30. Nothing in this chapter shall prevent a member of the General Court from referring a constituent to, or such member directly contacting on behalf of a person or constituent, a state agency or any entity funded by the state, to make a legislative inquiry, or to obtain information relating to the constituent who has requested legislative assistance from a member to make an inquiry on his or her behalf.  No state agency shall require a release from such constituent prior to a member dealing with such state agency or entity on the constituents behalf.
