To the Honorable Senate and House of Representatives,
Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as appearing in Article LXXXIX of said Amendments, I am filing for your consideration the attached legislation entitled, “An Act Authorizing the Town of Tisbury to Pay a Certain Unpaid Bill.”
The Tisbury Board of Selectmen requests that I file this special legislation on behalf of the Town of Tisbury.
Steam boiler replacement work at the Tisbury School was performed outside the scope of the Tisbury School’s routine service, repair and preventative contract procured through the Martha’s Vineyard Regional School District on behalf of various island towns. The Town of Tisbury should have made a full determination of approval or verification of available funds to comply with applicable public procurement and competitive bidding requirements.
This legislation would allow the Town to avoid potential liability and pay the outstanding invoice for work completed.

An Act authorizing the town of Tisbury to pay a certain unpaid bill.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. The treasurer of the town of Tisbury may pay from sums appropriated an unpaid bill incurred by the town in the amount of $44,729.96 to A.P. Fortes Plumbing & Heating, Inc. for steam boiler replacement at the Tisbury Elementary School, notwithstanding the failure of the town to comply with the laws relative to procurement and competitive bidding for furnishing of the work.
SECTION 2. This act shall take effect upon its passage.
