An Act to regulate Carfentanil.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 31 of chapter 94C of the General Laws is hereby amended by, in paragraph (a) inserting after the word, " (10) Betaprodine", the following: "(xx) Carfentanil, Acetyl fentanyl, furanyl fentanyl, and butryl fentanyl "
SECTION 2. Section 32E of chapter 94 C of the General Laws is hereby amended by inserting after paragraph c-1/2 the following new section; "(c-3/4) (c) Any person who trafficks in carfentanil or any salt or derivative thereof, by knowingly or intentionally manufacturing, distributing or dispensing or possessing with intent to manufacture, distribute, or dispense or by bringing into the Commonwealth a net weight of 5 grams or more of carfentanil or any salt or derivative thereof, or a net weight of 5 grams or more of any mixture containing carfentanil or any salt or derivative thereof, shall be punished by a term of imprisonment in state prison not to exceed 20 years."
