An Act to amend the town charter of Concord.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

“SECTION 1. The charter of the town of Concord is hereby amended by inserting the following preamble:-  Preamble. The legislative body of the Town is an open town meeting, open to all registered voters of the Town.

SECTION 2. Subsection B of section 1 of said charter of the town of Concord is hereby amended by striking out the word “selectmen”, each time it appears, and inserting in place thereof, in each instance, the following words:- members of the select board.

SECTION 3. Said subsection B of said section 1 of said charter of the town of Concord is hereby amended by striking out the word “selectman” and inserting in place thereof the following words:- member of the select board.

SECTION 4. Subsection C of said section 1 of said charter of the town of Concord is hereby amended by striking out the words “selectmen and members of” and inserting in place thereof the following words:- members of the select board and.

SECTION 5. Said subsection C of said section 1 of said charter of the town of Concord is hereby further amended by striking out the words “board of selectmen”, each time it appears, and inserting in place thereof, in each instance, the following words:- select board.

SECTION 6. Said subsection C of said section 1 of said charter of the town of Concord is hereby further amended by inserting after the third sentence the following sentence:- In the event that the moderator is absent, disabled from the performance of the moderator’s duties, or has been recused from acting as moderator, the deputy moderator elected at the Annual Town Meeting shall act as moderator; in the event of a vacancy in the position of moderator, the deputy moderator shall act as moderator until the next regularly elected moderator takes office. 

SECTION 7. Subsection A of section 2 of said charter of the town of Concord is hereby amended by striking out the word “selectmen” and inserting in place thereof the following words:- select board.

SECTION 8. Subsection B of said section 2 of said charter of the town of Concord is hereby amended by striking out the word “selectmen”, each time it appears, and inserting in place thereof, in each instance, the following words:- select board.

SECTION 9. Clause 1 of the second paragraph of said subsection B of said section 2 of said charter of the town of Concord is hereby amended by striking out the words “and revising the building code of the town”.

SECTION 10. Subsection C of said section 2 of said charter of the town of Concord is hereby amended by striking out the word “he” and inserting in place thereof the following words:- the moderator.

SECTION 11. Subsection D of said section 2 of said charter of the town of Concord is hereby amended by striking out the word “selectmen”, each time it appears, and inserting in place thereof, in each instance, the following words:- select board.

SECTION 12. Section 4 of said charter of the town of Concord is hereby amended by striking out the words “board of selectmen” and inserting in place thereof the following words:- select board.

SECTION 13. Said section 4 of said charter of the town of Concord is hereby further amended by striking out the word “he”, the first time it appears, and inserting in place thereof the following words:- the moderator or such select board member, school committee member or finance committee member.

SECTION 14. Said section 4 of said charter of the town of Concord is hereby amended by striking out the word “selectmen” and inserting in place thereof the following words:- select board.

SECTION 15. Said section 4 of said charter of the town of Concord is hereby further amended by striking out the word “he”, the second time it appears, and inserting in place thereof the following words:- the town manager.

SECTION 16. Section 5 of said charter of the town of Concord is hereby amended by striking out the word “selectmen”, each time it appears, and inserting in place thereof, in each instance, the following words:- select board.

SECTION 17. Said section 5 of said charter of the town of Concord is hereby further amended by striking out the word “his”, the first time it appears, and inserting in place thereof the following words:- the town manager’s.

SECTION 18. Said section 5 of said charter of the town of Concord is hereby further amended by striking out the word “his”, the second time it appears.

SECTION 19. Said section 5 of said charter of the town of Concord is hereby further amended by striking out the word “he”, each time it appears, and inserting in place thereof, in each instance, the following words:- the town manager.

SECTION 20. Said section 5 of said charter of the town of Concord is hereby further amended by striking out the word “his”, the third time it appears, and inserting in place thereof the following words:- the town manager.

SECTION 21. Section 6 of said charter of the town of Concord is hereby amended by striking out the word “he” and inserting in place thereof the following words:- the town manager.

SECTION 22. Said section 6 of said charter of the town of Concord is hereby further amended by striking out the word “selectmen”, each time it appears, and inserting in place thereof, in each instance, the following words:- select board.

SECTION 23. Said section 6 of said charter of the town of Concord is hereby further amended by striking out the word “selectman” and inserting in place thereof the following words:- member of the select board.

SECTION 24. Section 7 of said charter of the town of Concord is hereby amended by striking out the word “selectmen”, each time it appears, and inserting in place thereof, in each instance, the following words:- select board.

SECTION 25. Said section 7 of said charter of the town of Concord is hereby further amended by striking out the word “his”, each time it appears, and inserting in place thereof, in each instance, the following words:- the town manager’s.

SECTION 26. Said section 7 of said charter of the town of Concord is hereby further amended by striking out the word “him”, each time it appears, and inserting in place thereof, in each instance, the following words:- the town manager.

SECTION 27. Section 8 of said charter of the town of Concord is hereby amended by striking out the word “him” and inserting in place thereof the following words:- the town manager.

SECTION 28. Said section 8 of said charter of the town of Concord is hereby further amended by striking out the word “selectmen” and inserting in place thereof the following words:- select board.

SECTION 29. Section 9 of said charter of the town of Concord is hereby amended by striking out the word “him”, each time it appears, and inserting in place thereof, in each instance, the following words:- the town manager.

SECTION 30. Said section 9 of said charter of the town of Concord is hereby further amended by striking out the word “he”, each time it appears, and inserting in place thereof, in each instance, the following words:- the town manager.

SECTION 31. Clause B of said section 9 of said charter of the town of Concord is hereby amended by inserting after the word “three” the following word:- members.

SECTION 32. Said section 9 of said charter of the town of Concord is hereby further amended by striking out the word “selectmen”, each time it appears, and inserting in place thereof, in each instance, the following words:- select board.

SECTION 33. Said section 9 of said charter of the town of Concord is hereby further amended by striking out the word “his”, each time it appears, and inserting in place thereof, in each instance, the following words:- the town manager’s.

SECTION 34. Clause H of said section 9 of said charter of the town of Concord is hereby amended by striking out the words “board of selectmen” and inserting in place thereof the following words:- select board.

SECTION 35. Section 10 of said charter of the town of Concord is hereby amended by striking out the word “his”, each time it appears, and inserting in place thereof, in each instance, the following words:- the town manager’s.

SECTION 36. Section 11 of said charter of the town of Concord is hereby amended by striking out the word “his”, the first time it appears, and inserting in place thereof the following words:- such committee or board member’s or officer’s.

SECTION 37. Said section 11 of said charter of the town of Concord is hereby further amended by striking out the word “his”, the second time it appears, and inserting in place thereof the following word:- such.

SECTION 38. Said section 11 of said charter of the town of Concord is hereby further amended by striking out the word “his”, the third time it appears, and inserting in place thereof the following words:- said individual’s.

SECTION 39. Section 13 of said charter of the town of Concord is hereby amended by striking out the word “his” and inserting in place thereof the following words:- the town clerk’s.

SECTION 40. Said section 13 of said charter of the town of Concord is hereby further amended by striking out the words “chairman of the Board of Selectmen” and inserting in place thereof the following words:- select board chair.

SECTION 41. Section 14 of said charter of the town of Concord is hereby amended by striking out the word “selectmen” and inserting in place thereof the following words:- select board.

SECTION 42. Section 15 of said charter of the town of Concord is hereby amended by striking out the word “him”, each time it appears, and inserting in place thereof, in each instance, the following words:- such official.

SECTION 43. Section 16 of said charter of the town of Concord is hereby amended by striking out the word “selectmen” and inserting in place thereof the following words:- select board.

SECTION 44. Said section 16 of said charter of the town of Concord is hereby further amended by striking out the word “He”, each time it appears, and inserting in place thereof, in each instance, the following words:- The town manager.

SECTION 45. Said section 16 of said charter of the town of Concord is hereby further amended by striking out the word “his” and inserting in place thereof the following words:- the town manager’s.

SECTION 46. Said section 16 of said charter of the town of Concord is hereby further amended by striking out the word “him” and inserting in place thereof the following words:- the town manager.

SECTION 47. Section 17 of said charter of the town of Concord is hereby amended by striking out the word “selectmen”, each time it appears, and inserting in place thereof, in each instance, the following words:- select board.

SECTION 48. Section 18 of said charter of the town of Concord is hereby amended by striking out the word “selectmen” and inserting in place thereof the following words:- select board.

SECTION 49. Said section 18 of said charter of the town of Concord is hereby further amended by striking out the word “his” and inserting in place thereof the following word:- their.

SECTION 50. Section 21 of said charter of the town of Concord is hereby amended by striking out the word “sixty” and inserting in place thereof the following words:- one hundred twenty.

SECTION 51. Said section 21 of said charter of the town of Concord is hereby further amended by striking out the word “selectmen”, the first time it appears, and inserting in place thereof, in each instance, the following words:- select board.

SECTION 52. Said section 21 of said charter of the town of Concord is hereby further amended by striking out the words “duty of the selectmen” and inserting in place thereof, in each instance, the following words:- duty of the select board.

SECTION 53. Said section 21 of said charter of the town of Concord is hereby further amended by striking out the word “his” and inserting in place thereof the following word:- their.

SECTION 54. Said section 21 of said charter of the town of Concord is hereby further amended by striking out the words “board of selectmen” and inserting in place thereof the following words:- select board.”
