SECTION 1. Notwithstanding sections 12A, 16C and 17 of chapter 138 of the General Laws, the licensing authority of the city of Medford may grant 1 additional license for the sale of all alcoholic beverages to be drunk on the premises pursuant to section 12 of said chapter 138 to a person or entity that is operating the Chevalier Theatre under a contract, lease or other agreement to operate and manage the Chevalier Theatre or that has been granted a concession by the civic auditorium and convention center commission of the city of Medford for the sale of food and alcoholic beverages; provided, however, that, notwithstanding the provisions of said section 12 to the contrary, the holder of the license shall not be required to have the licensed premises open during any hours when there is no activity being conducted in the Chevalier Theatre and shall not be permitted to serve alcoholic beverages to any person who is not attending an activity then being conducted in the Chevalier Theatre. The license issued pursuant to this section shall be restricted for use on the premises of the Chevalier Theatre, or any part thereof, located at 30 Forest street in the city of Medford and shall be subject to: (i) all of said chapter 138, except said sections 12A, 16C and 17 and those provisions of said section 12 that are inconsistent with this section; and (ii) such terms and conditions consistent with this act as the licensing authority shall determine.
SECTION 2. Notwithstanding any general or special law or ordinance to the contrary, the licensing authority of the city of Medford may issue 1 common victualler’s license for the premises of the Chevalier Theatre or any part thereof, pursuant to section 2 of chapter 140 of the General Laws, to a person that is operating the Chevalier Auditorium under a contract, lease or other agreement to operate and manage the Chevalier Auditorium or that has been granted a concession by the civic auditorium and convention center commission of the city of Medford for the sale of food and beverages; provided, however, that the holder of the license shall not be permitted to serve food to any person who is not attending an activity then being conducted in the Chevalier Theatre. Section 5 of said chapter 140 shall not apply to the license issued pursuant to this section.
SECTION 3. The licensing authority shall not approve the transfer of the license granted pursuant to section 1 to any other location but it may grant the license to a new applicant at the same location if the applicant files with the licensing authority a letter from the department of revenue and a letter from the department of unemployment assistance indicating that the license is in good standing with those departments and that all applicable taxes, fees and contributions have been paid.
If the license granted pursuant to section 1 is cancelled, revoked or no longer in use at the location of original issuance, it shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority, which may then grant the license to a new applicant at the same location under the same conditions as specified in this act.
SECTION 4. This act shall take effect upon its passage.
