An Act relative to underground storage tank remediation.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding any provision of the General or Special Laws or Administrative Regulations, citizens of the Commonwealth subject to damage caused by the release of petroleum from an underground storage tank shall be eligible to recover funds remediating personal and legal expenses and loss of property value.  Said funds shall be recovered with proof of assessable financial damage and shall not be subject to the requirement of the judgment of a court of law. Said funds shall be paid from the fund enumerated in Mass General Laws Chapter 21J.

SECTION 2. This legislation shall pertain to any and all properties undergoing remediation through the 21J fund at the time of enactment.
