An Act authorizing the exchange of a parcel of land located on the Lenox/Richmond town line, owned by the town of Lenox with two parcels of land in Lenox, located on West Mountain Road and West Dugway Road.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding chapter 30B of the General Laws, but subject to paragraphs (a), (b) and (g) of section 16 of chapter 30B, the town of Lenox may convey a certain parcel of land, containing 105.0 acres, more or less, located in Lenox, on the Lenox/Richmond town line (map 26, lot 2), owned by the town of Lenox pursuant to chapters 110 and 423 of the 1869 statutes, said parcel currently under the care, custody and control of the board of selectmen, in exchange for two parcels of land, being (i) a parcel of land containing 48.0 acres, more or less, located on West Mountain road, Lenox (map 21, lot 4), described in a deed recorded with the Berkshire middle district registry of deeds in book 1053, page 896; and (ii) a parcel of land containing 81.8 acres, more or less, located on West Dugway road, Lenox (map 22, lot 10), described in a deed recorded with the Berkshire middle district registry of deeds in book 1464, page 269, said parcels to be used for open space and passive recreation purposes.
SECTION 2. This act shall take effect upon its passage.
