An Act Article 97 Land Conveyance in the town of Petersham.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to provide forthwith for the department of conservation and recreation to release a watershed preservation restriction over a portion of certain land in the town of Petersham, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Notwithstanding any general or special laws to the contrary, the department of conservation and recreation may release a watershed preservation restriction taken by the department pursuant to section 17 of chapter 92A ½ of the General Laws upon a portion of certain land in the town of Petersham described in an order of taking recorded in the Worcester county registry of deeds book 56243, page 62, dated November 1, 2016.  The exact boundaries of the portion of the land to be released from the watershed preservation restriction pursuant to this section shall be determined by the commissioner of conservation and recreation based on a survey.    

SECTION 2. The Hardwick Road Realty Trust shall assume all costs associated with engineering, surveys, appraisals, document preparation and other expenses deemed necessary by the commissioner of conservation and recreation to execute the release authorized pursuant to section 1.
