An Act relative to public health dental hygienists.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Chapter 112 of the Massachusetts General Laws, as appearing in the 2014 Official Edition, is hereby amended in Section 51 by inserting in the third paragraph after the words “a written collaborative agreement” the following- “No medical malpractice insurer shall refuse primary medical malpractice insurance coverage to a licensed dentist on the basis of whether they entered into a written collaborative agreement with a public health dental hygienist.  A dentist who enters into a collaborative agreement shall be indemnified from claims made against said public health dental hygienist.”

SECTION 2. Chapter 175 of the Massachusetts General Laws, as appearing in the 2014 Official Edition, is hereby amended in Section 193U by inserting in the second paragraph after the word “commonwealth” the following –““No medical malpractice insurer shall refuse primary medical malpractice insurance coverage to a licensed dentist on the basis of whether they entered into a written collaborative agreement with a public health dental hygienist.  A dentist who enters into a collaborative agreement shall be indemnified from claims made against said public health dental hygienist.”
