SECTION 1. The title of Section 3 of Chapter 111M of the General Laws is hereby amended by inserting the following language:
“and exemption for Massachusetts residents living in a foreign country” after “exemption for refusal of coverage based upon sincerely held religious beliefs;”
SECTION 2: Section 3 of Chapter 111M of the General Laws is hereby amended by inserting after section 3 the following section:
“Section 3(a). A Massachusetts resident living in a foreign country for at least 330 days of a 12-month period is not required to obtain and maintain creditable coverage for that 12-month period. A Massachusetts resident who is uninsured and living abroad under this definition, will not be assessed a penalty."
