An Act relative to the removal of a trustee of condominium or homeowner associations.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 10 of Chapter 183A of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by inserting after subsection (n) the following subsection :-

(o) An elected trustee may be removed before the expiration of his/her term of office, with or without cause, by a vote of the unit owners at a meeting duly called where the unit owners representing a simple majority percentage interest of more than 50 per cent of those present vote in favor of removal. Said unit owners may also vote at said meeting to elect a replacement.
