An Act relative to registry of deeds recording fees.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding any general or special law to the contrary, fees collected pursuant to the fee structure in place under section 23 of chapter 60 of the General Laws, section 38 of chapter 262 of the General Laws, and section 39 of chapter 262 of the General Laws prior to March 15, 2003 shall continue to be deposited into the General Fund by the registries of deeds operated by the Commonwealth pursuant to section 5 of chapter 34B of the General Laws. The registries of deeds operated by counties shall continue to deposit such fees with the county treasurer pursuant to section 39 of chapter 36 of the General Laws. Fees collected in excess of said prior fee structure on or after July 1, 2017 pursuant to section 6 and 51 to 59 of Chapter 4 of the Acts of 2003, excluding all such fees collected by the registers of deeds which are operated by counties, shall be deposited into the General Fund of the commonwealth. The registries of deeds operated by counties shall deposit such fees with the county treasurer pursuant to section 39 of chapter 36 of the General Laws.

SECTION 2. This act shall take effect upon its passage.
