SECTION 1. Chapter 265 of the General Laws is hereby amended by striking out section 13D, as appearing in the 2014 Official Edition, and inserting in place thereof the following section:-
Section 13D. Whoever commits an assault and battery upon any public employee when such person is engaged in the performance of his duties at the time of such assault and battery, shall be punished by imprisonment in the house of correction for not more than 2 1/2 years or by imprisonment in the state prison for not more than 5 years or by a fine of not less than $1,000 nor more than $10,000.
SECTION 2. This act shall take effect upon its passage.
