An Act relative to larceny.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 30 of chapter 266 of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by striking out, in line 9 and lines 13 and 14, the words “two hundred and fifty dollars” and inserting in place thereof, in each instance, the following figure:- $1,500.

SECTION 2. Said section 30 of said chapter 266, as so appearing, is hereby further amended by inserting after the word “dollars”, in line 15, the following words:- ; or, if the value of the property stolen exceeds $250 but is less than $500, shall be punished by imprisonment in a jail or house of correction for not more than 1 year or by a fine of not more than $500; or, if the value of the property stolen exceeds $500 but is less than $1,000, shall be punished by imprisonment in a jail or house of correction for not more than 1 year or by a fine of not more than $1,000; or, if the value of the property stolen exceeds $1,000 but is less than $1,500, shall be punished by imprisonment in a jail or house of correction for not more than 1 year or by a fine of not more than $2,500.

SECTION 3. Said section 30 of said chapter 266, as so appearing, is hereby further amended by striking out, in lines 15 to 23, inclusive, the words “; or, if the property was stolen from the conveyance of a common carrier or of a person carrying on an express business, shall be punished for the first offence by imprisonment for not less than six months nor more than two and one half years, or by a fine of not less than fifty nor more than six hundred dollars, or both, and for a subsequent offence, by imprisonment for not less than eighteen months nor more than two and one half years, or by a fine of not less than one hundred and fifty nor more than six hundred dollars, or both”.

SECTION 4. Said section 30 of said chapter 266, as so appearing, is hereby further amended by adding the following paragraph:-

(6) Law enforcement officers may arrest without warrant any person an officer has probable cause to believe has committed the offense of larceny, as defined in this section, where the value of the property stolen exceeds $250.

SECTION 5. Section 30A of said chapter 266, as so appearing, is hereby amended by striking out, in lines 35 and 42, and in lines 46 and 47, the words “one hundred dollars” and inserting in place thereof, in each instance, the following figure:- $250.

SECTION 6. Section 37A of said chapter 266, as so appearing, is hereby amended by inserting after the word “name”, in line 7, the following words:- , or the code or number used to identify that instrument or device or an account of credit or cash accessed by that instrument or device.

SECTION 7. Said section 37A of said chapter 266, as so appearing, is hereby further amended by inserting after the word “credit”, in line 9, the following words:- or by debit from a cash account.

SECTION 8. Section 37B of said chapter 266, as so appearing, is hereby amended by striking out, in lines 24 and 25, 29 and 30, 37 and 38, and in lines 45 and 46, the words “two hundred and fifty dollars” and inserting in place thereof, in each instance, the following figure:- $1,500.

SECTION 9. Said section 37B of said chapter 266, as so appearing, is hereby further amended by striking out, in lines 49 and 50, the words “five hundred dollars” and inserting in place thereof the following figure:- $3,000.

SECTION 10. Section 37C of said chapter 266, as so appearing, is hereby amended by striking out, in lines 12, 17 and 23, and in lines 31 and 32, the words “two hundred and fifty dollars” and inserting in place thereof, in each instance, the following figure:- $1,500.

SECTION 11. Said section 37C of said chapter 266, as so appearing, is hereby further amended by striking out, in lines 39 and 40, the words “two thousand dollars” and inserting in place thereof the following figure:- $5,000.

SECTION 12. Section 60 of said chapter 266, as so appearing, is hereby amended by striking out, in line 13, the figure “$250” and inserting in place thereof the following figure:- $1,500.

SECTION 13. Said section 60 of said chapter 266, as so appearing, is hereby further amended by striking out, in line 15, the figure “$1,000” and inserting in place thereof the following figure:- $2,500.

SECTION 14. Said section 60 of said chapter 266, as so appearing, is hereby further amended by striking out, in lines 16 and 20, the figure “$250” and inserting in place thereof, in each instance, the following figure:- $1,500.

SECTION 15. Section 127 of said chapter 266, as so appearing, is hereby amended by striking out, in line 13, the words “two hundred and fifty dollars” and inserting in place thereof the following figure:- $1,500.
