An Act relocating certain harbor lines in the Fairhaven and New Bedford Harbors.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 1.  Section 1, of Chapter 80 of the Acts of 1929, as amended by Section 1 of Chapter 168 of the Acts of 1929 and as further amended by Section 1, of Chapter 127 of the Acts of 1937, and Section of Chapter 96 of the events of 1946, is further amended by striking out the harbor description between points T1 and V1 and inserting in place thereof the following paragraph:

Beginning at a point of T1 in latitude four thousand, seven hundred and two and seven hundredths feet north and longitude five thousand and forty-seven and seventy-five hundredths feet west, said point T1 being north forty-seven degrees, one minute, fifty-seven seconds west, true bearing, six thousand, eight hundred, and ninety-eight and fifty hundredths feet from Mark 1.  (Mark 1 is described as “Mark 1” located by the United States Coast and Geodetic Survey and known as “New Bedford Fort” north latitude forty-one degrees, thirty-seven minutes and twenty-seven and sixty-six thousands seconds and west longitude seventy degrees, fifty-four minutes, ten and four hundred nine thousandths seconds) Distances hereinafter called latitude, in feet, from a line at right angles to said meridian and passing through said point and the bearings refer to the true meridian passing through said point.  From point T1 south fifty-two degrees, forty-five minutes, forty-one seconds east, true bearing, eight hundred and one and twenty hundredths feet to point U1 in latitude four thousand, two hundred and seventeen and twenty-four hundredths north and longitude four thousand, four hundred and nine and ninety hundredths west.  Said point U1 being located north zero degrees, forty-eight minutes, thirty-five seconds west, true bearing, one hundred and seven and fifty-six hundreds feet from Mark 16.  Mark 16 described as “Mark 16” near the northwesterly corner of the state pier in New Bedford; in latitude four thousand, one hundred and nine, and sixty-nine hundredth feet north and longitude four thousand, four hundred and eight, and thirty- eight hundredths feet west.  From point U1 south eighty-four degrees, forty-two minutes, seventeen seconds east, true bearing, one hundred and forty-one and eighty-four hundredths feet to point U2 in latitude four thousand, two hundred and four and fifteen hundredths feet north and longitude four thousand, two hundred and sixty-eight and sixty-seven hundredths west.  From point U2 south twelve degrees, twenty-nine minutes, thirty-six seconds east, true bearing, three thousand, four hundred and sixty-three and eighty-five hundredths feet to point V1 in latitude eight hundred and twenty-two and thirty-one hundredth feet north longitude three thousand, five hundred and nineteen and thirty-five hundredth feet west.

Section 2.  The metes and bounds inserted by section one, being relocation of the harbor lines encompassing The New Bedford State Pier in Fairhaven and New Bedford Harbors between harbor line point “T1” and “V1” as shown on a plan dated December 7, 2004, drafted by BCE, 184 West Central St., Franklin, MA 02038, shall be filed with the Department of Conservation and Recreation, the Department of Environmental Protection and with the Engineer of the City of New Bedford.

Section 3. This act shall take effect upon its passage.
