An Act regulating shared micro-mobility devices.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. The definition of “motorized scooter” in section 1 of chapter 90 of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by inserting after the word “bicycle” in line 271 the following words:- , a micro-mobility device, as defined in section 1 of chapter 159A½.

SECTION 2. Section 1 of chapter 159A½ of the General Laws, as so appearing, is hereby amended by inserting after the definition of “Division” the following definition:-

“Micro-mobility device”, a single-rider electric scooter or bicycle with a maximum speed of 15 miles per hour that is offered for consumer rental by a transportation network company or any other electric-powered single rider device with a maximum speed of 15 miles per hour, as designated by the department, that is offered for consumer rental by a transportation network company.

SECTION 3. The definition of “Transportation network company” in said section 1 of said chapter 159A½, as so appearing, is hereby amended by inserting after the word “transportation”, in line 24, the following words:- or to connect riders to a micro-mobility device for the purpose of using said micro-mobility device.

SECTION 4. The definition of “Transportation network driver” in said section 1 of said chapter 159A½, as so appearing, is hereby amended by inserting after the word “company”, in line 29, the following words:- , including a driver certified to find, charge or distribute micro-mobility devices.

SECTION 5. The definition of “Transportation network rider” in said section 1 of said chapter 159A½, as so appearing, is hereby amended by inserting after the word “behalf”, in line 37, the following words:- and a rider of a micro-mobility device.

SECTION 6.  The definition of “Transportation network services” in said section 1 of said chapter 159A½, as so appearing, is hereby amended by inserting after the word “ride”, in line 44, the second time it appears, the following words:- , or a driver retrieving or distributing a micro-mobility device.

SECTION 7. Section 3 of said chapter 159A½, as so appearing, is hereby amended by inserting after the word “ride”, in line 3, the following words:- or retrieving or distributing micro-mobility devices.

SECTION 8. Section 10 of said chapter 159A½, as so appearing, is hereby amended by inserting after the word “company”, in line 8, the following words:- , except for the distribution, retrieval or consumer rental of micro-mobility devices.

SECTION 9. Said section 10 of said chapter 159A½, as so appearing, is hereby further amended by inserting after the word “requirements”, in line 11, the words:- ; provided, however, that a municipality or other local or state entity may regulate the distribution, retrieval or consumer rental of micro-mobility devices.
