An Act relative to disclosure of radio frequency notifications.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

The General Laws are hereby amended by adding after chapter 93K the following chapter:-

CHAPTER 93L. Consumer notice regarding the safe operation of mobile telephones

Section 1. If a cellular telephone manufacturer includes safety notifications in or on the owner's manual, or other packaging, of any product intended for eventual retail sale regarding (a) exposure to radio frequency energy, (b) compliance with regulatory requirements concerning radio frequency energy, or (c) instructions or precautions that reference a minimum distance between any person and the cellular telephone during operation of the cellular telephone, then the cellular telephone manufacturer shall ensure that:

(1) the full language of the safety notifications is plainly visible on the outside of the product packaging; or

(2) a label is plainly visible on the outside of the product packaging directing customers to the safety notifications within the manual.

Section 2. The safety notice required under section 1 of this chapter shall be in letters not less than 1/16 inch in height. The initial words ''NOTICE'' must appear in capital letters and in bold type at least 1/8 inch in height, followed by either the full language of the safety notifications or language directing the user to the safety notifications within the owner’s manual or other packaging.
