An Act to require periodic regulatory review at the Department of Revenue.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 6 of Chapter 14 of the Massachusetts General Laws, as appearing in the 2010 official edition, is hereby amended by inserting after paragraph 9, the following new paragraph:-
10. Shall review rules and regulations promulgated by the department at least once every five years. The commissioner shall evaluate the need, clarity of language, and relevance of rules and regulations by following an establish criteria including but not limited to the scope and intent of the statutory authority; the benefits received and the costs imposed on the commonwealth; the burden imposed on taxpayers; the impact of cumulative regulations; and the appearance of duplicative regulations.
The commissioner shall report to the governor, secretary of administration and finance, the joint committee on state administration and regulatory oversight, and the house and senate committees on ways and means the finding and recommendations, if any, together with drafts of regulation and legislation necessary to carry the recommendations into effect by filing the same with the clerks of the senate and house of representatives on or before December 31 of each year a report is due.
