SECTION 1. Notwithstanding any general or special law to the contrary, the Massachusetts Bay Transportation Authority shall provide written notice to the clerks of the senate and house no less than 14 days prior to the remittance or forgiveness of any fines or penalties levied against any current or future commuter rail service provider.
The Massachusetts Bay Transportation Authority, in conjunction with the Massachusetts Department of Transportation, shall submit an annual report on or before January 1 detailing the number of instances during the previous calendar year that fines or penalties levied against a commuter rail service provider are remitted or forgiven. The report shall include, but not be limited to: (1) the amount of fines or penalties remitted or forgiven in each instance; (2) the circumstances surrounding and reasons for the remittance or forgiveness in each instance; and (3) the project or service contracted for and the terms of the contract in each instance. The report shall be filed with the clerks of the senate and house who shall forward the same to the senate and house committees on ways and means and the joint committee on transportation.
