An Act relative to school bus driver licensing.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 8A ½ of Chapter 90 of the General Laws, as appearing the 2014 Official Edition, is hereby amended in line 16 by inserting after the word “registrar” the following:- “provided, however, that such person is determined to have a clean driving record at the time of application, as outlined in this section”.
SECTION 2. Said section 8A ½ of said Chapter 90, as so appearing, is hereby amended in line 54 by inserting after the word “section.” the following:- The registrar shall develop and promulgate an automatic reporting system for school bus drivers arrested for non-traffic violations.
SECTION 3. Said section 8A ½ of said Chapter 90, as so appearing, is hereby amended by inserting after the first paragraph the following paragraph:
For the purposes of this section, a person shall be determined to have a clean driving record if the person has:
(1) no traffic violations in the previous year;
(2) no major traffic violations, as defined in 211 CMR 134.10(3)(c), in the previous 5 years, and not more than 3 such violations in the applicant’s driving history;
(3) not more than 5 minor traffic violations, as defined in 211 CMR 134.10(3)(d), in the previous 5 years; and
(4) not more than 3 at-fault accidents in the previous 5 years.
