An Act protecting municipal authority relative to airports.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 39B of Chapter 90 of the General Laws is hereby amended in the fifth paragraph thereof by striking the last sentence and replacing it with the following:-
“Such rules and regulations, ordinances or by-laws, if pertaining to commercial private use, shall be submitted to the commission, and shall not take effect until approval by the commission.
Such rules and regulations, ordinances, or by-laws, if pertaining to non-commercial private use, shall not require approval by the commission, but shall be submitted to the commission for comment prior to approval by a municipality, provided that nothing herein shall require such comment on any other action from the commission prior to such rules and regulations, ordinances or by-laws taking effect.”
