An Act authorizing the trustees of the bathing beach in the town of Hingham to enter into a lease for the operation of the bathhouse facility and surrounding grounds.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

In accordance with M.G.L. Const. Amend. Art. 2, Section 8, and pursuant to Article 29 of the Town of Hingham 2016 Town Meeting, the Town of Hingham, by and through the Trustees of the bathing beach, does hereby petition the General Court for passage of an act relative to a lease for the bathing beach Bathhouse Facility and surrounding grounds located on Otis Street, Hingham, Massachusetts, as follows:

SECTION 1. Notwithstanding any general or special law to the contrary, the Trustees of the bathing beach in the Town of Hingham may enter into a lease for a term not to exceed thirty (30) years with a selected tenant for the operation of a snack stand, restrooms and bathhouse facilities at a newly constructed Bathhouse Facility and surrounding grounds in order to increase the public enjoyment of the area and adjacent waterfront. 

SECTION 2. Said Bathhouse Facility to be located in a new building to be constructed by the Town of Hingham on the property known as Town of Hingham Assessor’s Map 50, Lot 51 on Otis Street, Hingham, Massachusetts.  Said property is held in trust by the Trustees of the bathing beach in the Town of Hingham under Transfer Certificate of Title Number 5167 issued by the Plymouth County District of the Land Court and pursuant to Chapter 75 of the Acts and Resolves of the General Court of 1934.

SECTION 3. Said lease shall be awarded to a selected tenant pursuant to a request for proposals issued under M.G.L. c. 30B, § 16 on file with the Town of Hingham.

SECTION 4. This act shall take effect upon its passage.
