An Act relative to the Sex Offender Registry Board.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 178F of chapter 6 of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by striking out, in line 2, the figure “2” and inserting in place thereof the following words:- 1, a level 2.
SECTION 2. Section 178F1/2 of said chapter 6, as so appearing, is hereby amended by striking out, in lines 2, 16 and 60, the figure “2” and inserting in place thereof, in each instance, the following words:- 1, a level 2.
SECTION 3. Section 178I of said chapter 6, as so appearing, is hereby amended by striking out, in line 16, the figure “2” and inserting in place thereof the following words:- 1, a level 2.
SECTION 4. Paragraph (2) of subsection (b) of section 178J of said chapter 6, as so appearing, is hereby amended by striking out, in line 31, the word “inquire” and inserting in place thereof the following words:- for finally classified level 2 and level 3 offenders, (i) inquire.
SECTION 5. Said subsection (b) of said section 178J of said chapter 6, as so appearing, is hereby further amended by striking out, in line 42, the figure “(3)” and inserting in place thereof the following figure:- (ii).
SECTION 6. Subsection (c) of said section 178J of said chapter 6, as so appearing, in hereby amended by inserting after the figure “178K,” in line 48, the following words:- or as a level 1 offender under section 178K, provided such level 1 offender has been specifically identified by name as described in paragraph (1) of subsection (b),.
SECTION 7. Paragraph (5) of said subsection (c) of said section 178J of said chapter 6, as so appearing, is hereby amended by striking out, in line 58, the word and.
SECTION 8. Paragraph (6) of said subsection (c) of said section 178J of said chapter 6, as so appearing, is hereby amended by striking out the punctuation “.” and inserting in place thereof the following words:- , only for finally classified level 2 or level 3 offenders; and.
SECTION 9. Subsection (a) of paragraph 2 of section 178K of said chapter 6, as so appearing, is hereby amended by striking out, in line 104, the word not.
SECTION 10. Said subsection (a) of said paragraph (2) of said section 178K of said chapter 6, as so appearing, is hereby further amended by inserting after the word “by,” in line 105, the following word:- limited.
SECTION 11. Said subsection (a) of said paragraph (2) of said section 178K of said chapter 6, as so appearing, is hereby further amended by striking out the third and fourth sentences and inserting in place thereof the following 2 sentences:- The public shall have access to the information regarding a level 1 offender in accordance with the provisions of sections 178D, 178I and 178J. The sex offender shall be required to register and to verify registration information pursuant to section 178F1/2.
