To the Honorable Senate and House of Representatives,
Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as appearing in Article LXXXIX of said Amendments, I am filing or your consideration the attached legislation entitled, "An Act validating certain proceedings of the town of Concord."
I am filing this special legislation on behalf of the Concord Select Board and its Town Manager.
The town of Concord recently discovered that it had not met a local by-law requiring the posting of the warrant for a Special Town Meeting at the Concord Town House and in at least one public location in each precinct of the town at least fourteen days in advance of the meeting. Instead, the town posted the warrant on Tuesday, September 18, only thirteen days in advance of the Special Town meeting which is schedule for October 1, 2018. Prior to September 17, however, the town mailed a copy of the warrant to every household in Concord and posted a copy of the warrant on the town's website. This legislation would validate all acts and votes taken at the Special Town Meeting and any action taken pursuant to those acts and votes.

An Act validating certain proceedings of the town of Concord.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding section 10 of chapter 39 of the General Laws or any other general or special law or town by-law or charter provision to the contrary, all acts, proceedings and votes taken by the town of Concord at its special town meeting on October 1, 2018 and all actions taken pursuant thereto are hereby ratified, validated and confirmed to the same extent as if notice of the meeting had been published as required by law.
SECTION 2. This act shall take effect upon its passage.
