SECTION 1. Section 22 of chapter 15A of the General Laws, as appearing in the 2014 Official Edition, is hereby be amended, in line 14, by inserting after the word “process.” the following:-
“In any fiscal year during which 50 per cent of a state university’s operating costs are funded through state appropriations and 100 per cent of its collective bargaining obligations are funded through state appropriations, the state university shall not increase its fees. Each state university may petition for an increase with the board of higher education, and in contemplating approval, the board shall consider the quality of the educational programs offered at the community college or state university as well as the burden that the increase would impose on students.”
SECTION 2. Section 1A of chapter 75 of the General Laws, as appearing in the 2014 Official Edition, is hereby amended, in line 79, by striking out the word “auditor;” and inserting in place thereof the following:-
“auditor. In any fiscal year during which 50 per cent of the University of Massachusetts’ costs are funded through state appropriations and 100 per cent of its collective bargaining obligations are funded through state appropriations, the University of Massachusetts shall not increase its fees. The University of Massachusetts may petition for an increase with the board of higher education, and in contemplating approval, the board shall consider the quality of the educational programs offered at the community college or state university as well as the burden that the increase would impose on students;”
