An Act providing for the waiver of fees for contesting motor vehicle infractions.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. The first paragraph of paragraph (4) of subsection (A) of section 3 of chapter 90C of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by inserting, after the word:- “fees” in line 50, the following:- “; and provided further, when a hearing results in a ruling that the violator is not responsible, the registrar shall refund the court filing fee to the alleged violator within 60 days after the ruling and shall notify the trial court department that such amount shall be returned from the trial court retained revenue account to the registrar;” and said section is further amended by inserting, in line 71, after the phrase:- “before a justice” the following words:- “; provided, however, that the fee shall be waived or refunded if the hearing results in a ruling that the violator is not responsible”

SECTION 2: Subsection (a) of section 13 of chapter 6C of the General Laws, as so appearing, is hereby amended by inserting at the end thereof the following new sentence:- Upon the completion of a successful appeal, violation administrative fees shall be refunded.

Subsection (b) of section 13 of Chapter 6C of the General Laws, as so appearing, is hereby amended by inserting at the end thereof the following new sentence:- Upon the completion of a successful appeal, violation administrative fees shall be refunded.
