An Act clarifying municipal authority regarding cash sureties and foreclosures.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 127I of chapter 111 of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by adding the following paragraph:-

Notwithstanding any general or special law to the contrary, a municipality may, by ordinance or by-law, require an entity to provide a cash surety in an amount not to exceed $10,000 on vacant property that the entity has the lawful ability to enter upon and control when that entity is foreclosing or has foreclosed upon the property.
