Section 34 of Chapter 94C of the General Laws is hereby amended by replacing the sentence beginning with “Any” in line 9 with the following new sentence:-
“Any person who violates this section by possessing with the intent to distribute heroin shall for the first offense be punished by imprisonment in a house of correction for not more than five years or by a fine of not more than five thousand dollars, or both, and for a second or subsequent offense shall be punished by imprisonment in the state prison for not less than ten years nor more than twenty years or by a fine of not more than fifty thousand dollars and imprisonment in a jail or house of correction for not more than ten years.
