An Act relative to the definition of consistent with local needs in chapter 40b.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

The second sentence of the definition of “Consistent with local needs” in section 20 of chapter 40B of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by striking out clause (1) and inserting in place thereof the following clause:- (1) low or moderate income housing exists which is: (i) in excess of 10 per cent of the housing units reported in the latest federal decennial census of a city or town with a housing inventory of 5,000 units or more; (ii) in excess of 5 per cent of the housing units reported in the latest federal decennial census of a city or town with less than 5,000 housing units; or (iii) on sites comprising one and one half per cent or more of the total land area zoned for residential, commercial or industrial use, or.
