An Act to preserve access to inpatient mental health services for individuals with mental illness.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Chapter 265 of the General Laws is hereby amended by inserting at the end of Section 13I:

If the person alleged to have committed an assault or assault and battery was at the time of the alleged incident: 1) transported or held subject to Mass. Gen. L. ch. 123, § 12, §§ 10 & 11 or §§ 7 & 8; or 2) determined by mental health providers to need psychiatric evaluation or treatment, that person will not be charged under the provisions of this section but will be provided with mental health evaluation and treatment in accordance with Chapter 123.
