An Act holding habitual, violent offenders responsible for simultaneous crimes.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1: Section 133A of Chapter 127 of the General Laws, as most recently amended by Chapter 192 of the Acts of 2016, is hereby amended by striking out the words, “arising out of separate and distinct incidents that occurred at different times, where the second offense occurred subsequent to the first conviction”.

SECTION 2: Section 24 of Chapter 279 of the General Laws, as most recently amended by Chapter 192 of the Acts of 2016, is hereby amended by striking out the words, “arising out of separate and distinct incidents that occurred at different times, where the second offense occurred subsequent to the first conviction”.

SECTION 3: Section 25(b) of Chapter 279 of the General Laws, as most recently amended by Chapter 192 of the Acts of 2016, is hereby amended by striking out the words, “arising out of charges separately brought and tried, and”.

SECTION 4: Section 25(b) of Chapter 279 of the General Laws, as most recently amended by Chapter 192 of the Acts of 2016, is hereby amended by striking out the words, wherever they occur, “arising out of separate and distinct incidents that occurred at different times, where the second offense occurred subsequent to the first conviction”.
