An Act relative to apprenticeship programs.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 11G of chapter 23 of the 2016 General Laws as so appearing, is hereby amended by adding the following paragraph:-
The director and deputy director shall set up and administer, conditions and training standards for apprenticeship programs and apprenticeship agreements, which conditions and standards shall in no case be lower than those prescribed by said sections 11E to 11W, inclusive, shall create and implement with the division for recruitment, selection, employment, training and qualification of apprentices, that shall commit to having apprentices on public construction job site, for projects exceeding the cost of 7.5 Million Dollars, within 90 calendar days from the commencement of labor at the job site pursuant to the apprenticeship programs sponsor’s contract.
SECTION 2. Section 11H of Chapter 23 is hereby amended striking out the definition of "Apprenticeship program sponsor" and inserting in place thereof the following definition:-
"Apprenticeship program sponsor". A person, association, committee, organization, corporation, partnership, trust or other entity operating an apprentice program on public projects, administered by the director of the department of labor standards and the deputy director with the advice and guidance of the apprenticeship council, shall administer sections 11E to 11W, inclusive, who shall commit to having apprentices on job sites for public construction projects exceeding 7.5 million dollars within 90 calendar days from the commencement of its labor on the job site.
SECTION 3. Section 11H of Chapter 23 is hereby amended by adding the following paragraphs:-
"Public construction". shall mean and be inclusive of the following, when any public funding is appropriated for any state, municipal and/or county highways, roads, bridges and/or buildings that will be new construction, reconstruction, remodeling, retro fitting and/or refurbished.
