An Act to protect unemployment benefits for furloughed federal employees.

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to protect employees, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

Section 1. Section 23 of Chapter 151A is hereby amended by inserting after subsection (d), the following sentence:

(e) Notwithstanding the provisions of this subsection, the waiting period of one week for total or partial unemployment benefits referenced in subsection (a) shall not apply to any employee of the federal government or federal agency whose employment has been interrupted, suspended or terminated as a result of the shutdown or partial shutdown of the United States government that began on December 22, 2018.

Section 2. Section 69c of Chapter 151A is hereby amended by inserting after subsection (d) the following sentence: Notwithstanding the provisions of this subsection, a back pay award to an employee of the federal government or federal agency whose employment has been interrupted, suspended or terminated as a result of the shutdown or partial shutdown of the United States government that began on December 22, 2018 is not required to return unemployment benefits provided under this statute.
