An Act relative to recreational facilities and zoning.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 3 of Chapter 40A of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by inserting in paragraph 2 at the end after the word “utilities.” the following sentences:-

“In order for a nonprofit educational corporation to qualify under this section, the primary or dominant use must be for an educational purpose. Furthermore, recreational facilities shall not qualify under this section.”
