An Act relative to public safety in hoisting regulations.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 53 of Chapter 146 of the General Laws, as amended by chapter 6 of the acts of 2017, is hereby further amended by adding the following subsection:-
(h) The exemptions under subsections (e), (f) and (g) shall not apply to a public utility company or other company during the course of an employee strike or lockout unless: (i) the employees of the public utility company or other company who are not part of the strike or lockout have obtained a company license from an approved in-service training program of the public utility company for which they are performing work or other company specially authorized by the division of professional licensure pursuant to said subsection (g); or (ii) during a period of a declared emergency by the governor.
