An Act for the Commonwealth to procure zero-emission vehicles.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. (a) MGL Part I Title II Chapter 25A Section 11B shall be struck and replaced as follows:

Section 11B.

1) Motor vehicles owned and operated by the commonwealth, as they are removed from service, shall only be replaced with zero-emission vehicles. Light-duty passenger vehicles shall be replaced with zero-emission vehicles beginning on January 1, 2020. Heavy-duty vehicles shall be replaced with zero-emission vehicles beginning on January 1, 2021. The provisions of this section shall not apply in cases where the purchase of a hybrid electric or electric vehicle would result in an inability of the new vehicle to perform its intended duties. This exemption shall not apply to concerns about vehicle range.

2) Any motor vehicles exempted from the above paragraph shall only be replaced with vehicles that have above-average fuel efficiency for new vehicles within their size class as determined by the federal government.
