An Act regarding net metering for low income and other small facilities.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 139 of Chapter 164 of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by striking subsection (i) and inserting in the place thereof:- 

(i) A Class I net metering facility shall be exempt from the aggregate net metering capacity. A class I net metering facility that is not a net metering facility of a municipality or other governmental entity under subsection (f) shall also be exempt from subsection (b 1/2) and (k), and may net meter and accrue Class I net metering credits if it is generating renewable energy and the nameplate capacity of the facility is (1) equal to or less than 10 kilowatts on a single-phase circuit or (2) 25 kilowatts on a 3-phase circuit.
