An Act to promote local energy resiliency.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Chapter 164 of the General Laws is hereby amended with the addition of a new Section following Section 1K:

Section 1L. Distributed energy services; Microgrid operations

No right to exclusive service or franchise established within Section 1B or elsewhere in this chapter shall prevent a municipality, agencies of the Commonwealth, or private electric customers within an electric or gas company’s service territory, from procuring local or district energy services, establishing an energy microgrid, or utilizing public rights of way for the purposes of energy generation or resiliency.
