An Act requiring school bus monitors on school buses transporting students in kindergarten through grade five.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION  1.  Section 7B of chapter 90 of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by adding the following paragraph:-

Every school bus transporting school pupils enrolled in grade kindergarten through grade 5 shall have on board a school bus monitor, other than the school bus driver. Variances to the requirement for a school bus monitor may be granted by the commissioner of elementary and secondary education if the commissioner finds that an alternative plan provides substantially equivalent safety for children.  For purposes of this section, a school bus monitor shall be 18 years or older.

SECTION 2. The department of elementary and secondary education may promulgate regulations relative to school bus monitors as necessary to implement this act.
