An Act relative to wireless transmissions from motor vehicles.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to safeguard privacy, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public safety.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Notwithstanding any general or special law or regulation to the contrary, any state, county or local government authority or agency, and any person or entity acting on its behalf, that uses or captures radio or other wireless transmissions emitted from or to electronic devices for the purpose, in whole or in part, of monitoring, recording, or observing the movements, actions, or presence of persons or vehicles shall expunge all data related thereto within 45 days from the time such data is captured or created.
