An Act amending chapter 138.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 13 of Chapter 138 of the Massachusetts General Laws, as so appearing, is hereby amended by inserting after the phrase “prescribe” the following sub-section:

13 (a)Tastings aboard vessels:

Provided that any owner or operator of any vessel or shipping company carrying passengers and operating out of any port of the commonwealth who holds a license pursuant to this section may sponsor, promote, partner with or advertise a tasting with certain holders of licenses pursuant to Sections 19B, 19C and 19D of Chapter 138

Any owner or operator of any vessel or shipping company carrying passengers and operating out of any port of the commonwealth who holds a license pursuant to this section may provide on board sample wine or malt beverage tasting with certain holders of licenses pursuant to Sections 19B, 19C and 19D of Chapter 138; provided however, that such licensee shall not solicit orders for wine or malt for off premises consumption; and provided further, that any such wine tasting shall be limited to one ounce per serving and any such malt beverage tasting shall be limited to two ounces per serving and food shall be served in conjunction with any such wine or malt beverage tasting.

Any owner or operator of any vessel or shipping company carrying passengers and operating out of any port of the commonwealth who holds a license pursuant to this section may provide, without charge, on-premises sample alcoholic beverages tastings for prospective customers if such beverages shall be available for sale on board; provided, however, that no single serving of wine shall exceed one ounce and no single serving of malt beverages shall exceed two ounces. The holder of a license pursuant to this section shall not solicit orders for off premises consumption; provided, further, that the holder of a license issued pursuant to the provisions of this section shall control the dispensing of wine or malt beverage samples on board; and provided, further, that food shall be served in conjunction with such wine or malt beverage tasting conducted on the vessel of the holder of a license issued pursuant to this section.
