An Act relative to the punishment of the crimes of photographing, videotaping, or electronically surveilling nude or partially nude persons, or the sexual or intimate parts of a person under or around the person’s clothing.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. The first paragraph of subsection (b) of § 105 of Chapter 272 of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by inserting after the words “shall be punished by imprisonment in the house of correction for not more than 2½ years” the following language: “or in the state prison for not more than 5 years”.
SECTION 2. The second paragraph of subsection (b) of § 105 of Chapter 272 of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by inserting after the words “shall be punished by imprisonment in the house of correction for not more than 2½ years” the following language: “or by imprisonment in the state prison for not more than 5 years”.
SECTION 3. Section 178C of Chapter 6 of the General Laws, as amended by St. 2018, chapter 219, section 1, is hereby amended by inserting into the definition of “Sex offense” after the words “aggravated rape under section 39 of chapter 277;” the following: “photographing, videotaping or electronically surveilling another person who is nude or partially nude under section 105(b) of said chapter 272;”
