An Act regulating nicotine products.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Chapter 270, Section 6 of the General Laws, as so appearing, is hereby amended by adding the following subsection:

(x) No retailer, retail establishment, or other person or entity shall sell or distribute or cause to be sold or distributed or offer for sale any tobacco products as defined in Chapter 270 Section 6 containing more than four tenths of a milligram of nicotine per gram of tobacco for all tobacco products in solid form and one percent by volume nicotine for tobacco products in liquid form.

SECTION 2. Chapter 64C, Section 7B(a) of the General Laws, as so appearing, is hereby amended by adding the following definition:

“Vapor product”, any non-combustible product that employs a heating element, power source, electronic circuit, or other electronic, chemical or mechanical means, that can be used to produce vapor intended for human consumption, including but not limited to, any electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe, electronic hookah, vape pen, vaporizer or similar product or device and any container containing a consumable material that has been manufactured to be used with or in an electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe, electronic hookah, vape pen, vaporizer or similar product or device; provided, however, the term “vapor product” shall not include a tobacco product, as defined in this section, marijuana, as defined in section 1 of chapter 94G.

Section 3: Chapter 64C, Section 7B(b) of the General Laws, as so appearing, is hereby amended by striking out, in the first line of the subsection, the words “cigars and smoking tobacco” and inserting in place thereof the following words: “cigars, smoking tobacco, and vapor products”.
