An Act providing further transparency in the siting of marijuana facilities.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 1. Chapter 94G of the General Laws, as appearing in the 2016 Official Edition is hereby amended by adding the following new section:—

Section 3 ½ . Transparency in the Siting of Marijuana Facilities

(a) A city or town shall hold a public meeting on the siting of marijuana facilities prior to the issuance of any licenses or approval of any host agreement.

(b) As part of the licensing application, an applicant shall provide certified documentation confirming the adoption of the Cannabis Control Commission’s first operating principle, “to conduct all processes openly and transparently,” agreed to by the potential licensee and all participating municipal officials.

(c) The Cannabis Control Commission shall require the final draft of a Host Community Agreement be posted on the municipality’s web site, at least 14 days prior to a vote on acceptance, for review with the opportunity for residents to provide comments.

(d) The Cannabis Control Commission shall require the applicant’s Community Outreach Meeting to be held at least 14 days prior to the vote of any city or town on a Host Community Agreement.
